What is TERO?

TERO stands for Tribal Employment Rights Ordinance or Office. It ensures that qualified Indian/Alaska Native people receive their rightful share of employment, training, and business opportunities on or near the reservation.

The Legal Basis

A Tribe’s authority to enforce TERO is grounded in its inherent sovereign status. This power allows the Nation to set conditions for any employer operating within the exterior boundaries of the reservation. Tribal authority to tax and impose fees is a basic right of a sovereign government, confirmed by the U.S. Supreme Court.

Requirements for Employers

All covered employers operating within the Nation's jurisdiction must provide Indian preference in all aspects of employment. Key requirements include:

  • Compliance Plans: Submit a plan detailing how you will meet TERO requirements.
  • Skills Bank: Utilize the TERO skills bank for referrals and consider Indian applicants before non-Indians.
  • Hiring Goals: Agree to hire a specific number of Indians in each job classification.
  • Cultural Respect: Acknowledge and provide reasonable accommodations for tribal religious and cultural beliefs.
  • TERO Fees: Most employers are required to pay a fee, which finances program services like recruiting, screening, and investigations.

Exemptions & Sanctions

  • Exemptions: While direct government and non-profit employment may be exempt, all contractors are covered regardless of their funding source. Employers may also designate a "core crew" of essential, permanent employees.
  • Sanctions: Violations can result in civil fines ranging from $500 to $5,000 per violation, termination of operations, or the back payment of lost wages.
